Terms and Conditions

1  Introduction

These Terms & Conditions ("Terms") set out the basis on which EcoCert Worthing ("EcoCert", "we", "us") supplies Energy Performance Certificates (EPCs), floor‑plans and related consultancy (the "Services") to the Client ("you"). By booking or accepting our Services you confirm that you have read, understood and agree to be bound by these Terms.

2  Definitions

  • Appointment – the agreed date and time at which the Assessor attends the Property.

  • Assessor – an accredited Domestic (or where applicable Commercial) Energy Assessor engaged by EcoCert.

  • Property – the building or part‑building to be assessed.

3  Scope of Services

  1. Conduct a non‑invasive site survey of the Property.

  2. Collect data required under the Energy Performance of Buildings Regulations.

  3. Produce and lodge the EPC and, where ordered, a floor‑plan.

  4. Provide reasonable telephone / email clarification of the report.

4  Travel & Coverage

  • All quoted prices include travel of up to 5 (five) road miles from Worthing Pier, BN11 3PX.

  • Additional distance is chargeable at £0.45 per mile (round‑trip). Mileage is calculated using the fastest route shown by Google Maps.

  • Congestion, toll or parking fees incurred outside the 5‑mile radius will be re‑charged at cost.

5  Fees & Payment

  1. Fees will be confirmed in writing prior to the Appointment.

  2. Unless otherwise agreed, payment is due immediately upon completion of the site survey and before the EPC is released.

  3. Late payments attract interest at 8 % p.a. above the Bank of England base rate plus a £25 administration fee.

6  Client Obligations

  • Provide safe, unobstructed access to all relevant areas including lofts, meters and heating systems.

  • Ensure that the Assessor is informed of any recent improvements (e.g., insulation or renewable installations) and can inspect documentary evidence where required.

  • Pets must be secured and minors supervised during the survey.

7  Company Obligations

  • Perform the Services with reasonable care, skill and in accordance with all applicable regulations.

  • Hold valid Professional Indemnity (£250k) and Public Liability (£2 m) insurance.

  • Turnaround: subject to payment and receipt of any outstanding documentation, the EPC will be lodged and emailed within 48 hours of the Appointment.

8  Cancellation & Rescheduling

A new date will be offered subject to availability and settlement of any cancellation fee.

9  EPC Validity & Use

  • The EPC is valid for 10 years unless a subsequent assessment is lodged.

  • The EPC is provided for marketing, letting or compliance purposes and may be disclosed to prospective purchasers, tenants, financiers and professional advisers.

10  Liability & Limitations

  1. The survey is visual and non‑destructive; EcoCert accepts no liability for hidden defects or areas that are unsafe or inaccessible.

  2. EcoCert is not liable for loss arising from inaccurate or incomplete information supplied by you.

  3. EcoCert’s total liability (whether in contract, tort or otherwise) is limited to the price paid for the relevant Service.

11  Data Protection

EcoCert processes personal data in accordance with the UK GDPR and Data Protection Act 2018. Data is held securely, used solely for delivering the Services and statutory compliance, and never sold to third parties. Full privacy notice available on request.

12  Complaints & Disputes

Please raise any concerns within 14 days of receipt of the EPC by emailing info@ecocertworthing.co.uk. EcoCert will acknowledge within 3 working days and aim to resolve within 10 working days. Unresolved disputes are governed by the law of England & Wales and subject to the exclusive jurisdiction of its courts.

13  Force Majeure

EcoCert shall not be liable for delay or failure to perform resulting from events beyond its reasonable control, including but not limited to extreme weather, illness, strike action or regulatory changes.

14  Amendments

EcoCert may amend these Terms from time to time. The version in force at the time of booking shall apply. Updated Terms will be posted on our website and supplied on request.

15  Entire Agreement

These Terms constitute the entire agreement between EcoCert and the Client and supersede any prior understanding or representation, written or oral.

Acceptance

By booking an Appointment you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.
